Where is the line between treason and free speach?

Why is it that when some try to keep crime death and destruction out of his neiborhood and protect the innocent he is considered racists and anything he says is politicaly incorrect and should be prosecuted as a hate crime. However anything others say against his country and even during war time causing the death of many innocent is considered free speach.
